Welcome to Bass Boots. These Terms of Service govern your access to and use of our website, online store, content, products, and related services.
By visiting our website, creating an order, purchasing a product, submitting information, or otherwise using our services, you agree to these Terms of Service, our Return, Exchange & Refund Policy, our Shipping Policy, and our Privacy Policy.
Please read these Terms carefully before using our website. If you do not agree to them, do not access the website or use our services.
1. About Bass Boots
This website is operated by Bass Boots. Throughout these Terms, the words “Bass Boots,” “we,” “us,” and “our” refer to Bass Boots.
The words “you” and “your” refer to any visitor, customer, purchaser, or other person accessing or using our website or services.
Our online store is hosted through Shopify, which provides the ecommerce platform that enables us to offer and sell our products.
2. Eligibility
By using our website or placing an order, you represent that you are at least the age of majority in your state or place of residence and are legally capable of entering into a binding agreement.
You may not use our website or purchase our products for any unlawful, fraudulent, or unauthorized purpose.
If you are using the website on behalf of a business or other organization, you represent that you have authority to bind that organization to these Terms.
3. Products and Limited Releases
Bass Boots may be offered through limited releases, made-to-order sales, pre-sales, or other limited-inventory purchasing formats.
Products offered through a limited release may not be immediately available for shipment. Production may begin after the ordering period closes.
Placing an order does not guarantee that a product will remain available indefinitely or that the same product, color, size, price, or design will be offered again.
We may limit product quantities, discontinue products, modify future product versions, or restrict sales by customer, household, geographic region, or other reasonable criteria.
4. Product Descriptions and Images
We make reasonable efforts to display our products, colors, materials, dimensions, features, and specifications accurately.
Actual colors and appearance may vary depending on your device, screen settings, lighting conditions, production batch, materials, and manufacturing processes.
Minor variations in color, finish, texture, stitching, placement, packaging, or other nonmaterial characteristics are not necessarily defects.
Product photographs, videos, illustrations, mockups, and digital renderings are provided for general reference. Where a prototype, sample, or rendering is shown, the final production version may contain reasonable changes that do not materially alter the product’s primary function or overall character.
We reserve the right to correct product descriptions, images, specifications, pricing, availability, and other information when errors are identified.
5. Product Performance Claims
Bass Boots are designed for typical music-festival conditions, including extended walking, standing, dancing, light rain, mud, dirt, grass, pavement, and similar environments.
Descriptions such as “all-weather,” “water-resistant,” “mud-resistant,” “easy-clean,” “festival-proof,” or similar language describe the product’s intended features and ordinary use. They do not mean that Bass Boots are waterproof, indestructible, slip-proof, stain-proof, or suitable for every environment.
Bass Boots are not intended for full water submersion, extreme weather, hazardous terrain, industrial work, hiking, climbing, motorcycling, protective occupational use, or use as certified safety footwear.
Traction varies based on the surface, weather, wear, contaminants, and how the product is used. No footwear can eliminate the risk of slipping, tripping, falling, discomfort, injury, or damage.
Individual comfort and fit experiences vary. References to all-day comfort, long festival days, or similar descriptions are not guarantees that every customer will experience the same result.
6. Sizing and Fit
Customers are responsible for reviewing the available size information and selecting their size before completing an order.
Bass Boots are intended to fit true to size for most customers, but individual foot shape, width, orthotics, socks, and personal preferences may affect fit.
Recommendations to size up, use removable insoles, or accommodate custom inserts are general guidance and do not guarantee a particular fit.
Available size exchanges are governed by our Return, Exchange & Refund Policy and remain subject to product condition and inventory availability.
7. Orders and Order Acceptance
Submitting an order is an offer to purchase products under these Terms.
An order confirmation confirms that we received your order. It does not necessarily mean that we have accepted the order or that the product is guaranteed to be available.
We may accept, reject, limit, or cancel an order for reasons including suspected fraud, payment issues, inventory limitations, pricing errors, product errors, shipping restrictions, policy abuse, or other legitimate business reasons.
If we cancel an order after payment has been collected, we will refund the affected amount to the original payment method unless another method is required by law or agreed to with you.
We reserve the right to refuse service to anyone when legally permitted, provided that we do not discriminate in violation of applicable law.
8. Pricing, Taxes, and Payment
Prices are displayed in the currency shown at checkout and may change without notice.
The price applicable to an order is generally the price displayed when the order is submitted, subject to correction of obvious errors.
Shipping charges, sales taxes, duties, customs fees, and other applicable charges will be displayed at checkout when available or may be assessed by the applicable authority.
You represent that the payment information you provide is accurate, current, complete, and authorized for your use.
By submitting an order, you authorize us and our payment processors to charge the total amount shown at checkout.
We may use third-party payment processors. Their separate terms, privacy practices, fraud controls, and processing requirements may apply to your transaction.
9. Pricing and Promotional Errors
We may correct typographical errors, inaccurate prices, incorrect discounts, invalid promotional offers, or other mistakes appearing on our website.
If an obvious pricing or promotional error affects an order, we may contact you to offer the correct terms or cancel and refund the affected order.
We will not knowingly use pricing errors to charge you more than the amount you authorized without obtaining your approval.
Promotional codes, offers, and discounts may be limited by date, product, quantity, customer, or other stated conditions. Unless expressly permitted, promotions cannot be combined, transferred, redeemed for cash, or applied retroactively.
10. Production and Estimated Delivery
Bass Boots from limited releases may be produced after the ordering period closes.
Our current estimated production and delivery timeframe is approximately 12–16 weeks, unless a different estimate is clearly provided at the time of purchase.
Shipping and delivery dates are estimates and are not guaranteed.
Manufacturing delays, material availability, quality-control issues, customs processing, carrier delays, severe weather, labor interruptions, transportation disruptions, government actions, and other circumstances may affect production or delivery.
We will provide customer updates when reasonably practical.
If we cannot ship within the timeframe stated or otherwise required by applicable law, we will provide any legally required delay notice, revised estimate, consent request, cancellation option, or refund.
Nothing in these Terms eliminates any cancellation or refund right that cannot legally be waived.
11. Order Changes and Cancellations
You may request an order cancellation or modification by contacting returns@bassboots.co.
We will make reasonable efforts to accommodate requests received before production or fulfillment begins, but we cannot guarantee that an order can be canceled or changed.
Once production begins, we may be unable to cancel or modify an order because products may be produced specifically for the limited release.
Once an order ships, it cannot be canceled. Eligible purchases may instead be handled under our Return, Exchange & Refund Policy.
Submitting a cancellation or modification request does not mean the request has been approved. We will confirm the outcome by email.
12. Shipping
Customers are responsible for providing a complete and accurate shipping address.
We cannot guarantee that address changes can be made after an order enters fulfillment or ships.
Shipping dates, transit times, and delivery estimates provided by Bass Boots or a carrier are estimates unless expressly stated otherwise.
Shipping carriers operate independently from Bass Boots. However, nothing in these Terms eliminates responsibilities that remain legally ours as the seller.
Shipping issues, address errors, refused packages, unclaimed shipments, lost packages, and packages marked delivered are handled according to our Shipping Policy and Return, Exchange & Refund Policy.
13. Title and Risk of Loss
Ownership and risk of loss will transfer at the time permitted by applicable law.
Nothing in these Terms is intended to transfer risk to you earlier than legally permitted or to eliminate a valid claim involving merchandise that was not delivered, was delivered incorrectly, or was damaged before delivery.
If a package is lost, damaged, or incorrectly delivered, contact us promptly so we can review the issue and, when appropriate, work with the carrier.
14. Returns, Exchanges, and Refunds
Returns, size exchanges, damaged-product claims, cancellations, and refunds are governed by our Return, Exchange & Refund Policy, which is incorporated into these Terms.
Eligible Bass Boots may generally be returned within the period stated in that policy, provided all return conditions are satisfied.
Do not mail a return without prior authorization. Approved customers will receive the return address and shipping instructions by email.
If these Terms conflict with the Return, Exchange & Refund Policy regarding a return or exchange, the Return, Exchange & Refund Policy will control for that issue unless applicable law requires otherwise.
15. Charm Packs
Charm packs purchased from Bass Boots are final sale and are not eligible for standard returns, exchanges, or refunds.
This includes glow-in-the-dark charm packs, random charm packs, and other charm packs offered separately or alongside Bass Boots.
A charm pack may qualify for replacement, refund, or another reasonable resolution if it arrives damaged, defective, incomplete, or different from what was ordered.
Final-sale terms do not limit rights that cannot legally be waived.
16. Product Care and Customer Responsibilities
Customers are responsible for following product-care instructions and using Bass Boots appropriately.
Improper cleaning, machine washing, harsh chemicals, excessive heat, prolonged submersion, misuse, alterations, intentional damage, ordinary wear and tear, or use outside the product’s intended purpose may damage the product and may not qualify as a defect.
Customers should inspect footwear before use and discontinue use if the product becomes materially damaged, unstable, excessively worn, or unsafe.
17. Personal Use and Resale
Products are sold primarily for personal use unless we agree otherwise in writing.
You may not use automated purchasing systems, false identities, multiple accounts, payment manipulation, or other methods designed to evade purchase limits.
We may cancel orders we reasonably believe are intended for unauthorized commercial resale, fraudulent activity, market manipulation, or policy abuse.
Nothing in this section prohibits lawful resale rights that cannot be restricted under applicable law.
18. Intellectual Property
The Bass Boots name, logos, product designs, graphics, photographs, videos, text, website layout, branding, slogans, artwork, and other content are owned by or licensed to Bass Boots and are protected by applicable intellectual-property laws.
You may access and use our website for personal, noncommercial purposes.
You may not copy, reproduce, modify, distribute, publish, display, sell, license, reverse engineer, create derivative works from, or commercially exploit our content without prior written permission.
You may share links to our publicly available website and social content in a lawful manner that does not falsely suggest sponsorship, endorsement, partnership, or affiliation.
19. Customer Reviews, Photos, and Submissions
If you submit a review, comment, photograph, video, suggestion, testimonial, idea, or other content to Bass Boots, you represent that you have the right to submit it and that it does not violate another person’s rights.
You retain ownership of content you create.
By intentionally submitting content for publication, tagging Bass Boots with the apparent intent that we view or share the content, or otherwise giving us permission to use it, you grant Bass Boots a nonexclusive, worldwide, royalty-free license to reproduce, display, publish, adapt, and share that content for our website, social media, advertising, and promotional activities.
Where reasonably practical, we may identify you by your submitted name, username, or social-media handle.
You may contact us to request that we stop using customer-submitted content in future materials. We may not be able to remove content from materials already printed, distributed, archived, or published by third parties.
You may not submit content that is unlawful, defamatory, threatening, misleading, obscene, fraudulent, infringing, malicious, or otherwise harmful.
We may remove or decline to publish submitted content, but we are not obligated to monitor every submission.
We will not condition a refund, discount, or other benefit on a customer agreeing not to post an honest review.
20. Electronic Communications
By using our website, submitting an order, or contacting us electronically, you consent to receive transactional communications electronically.
These communications may include order confirmations, production updates, shipping notices, delay notices, return instructions, policy notices, and customer-service messages.
Transactional messages are separate from optional marketing communications.
You may unsubscribe from marketing emails using the instructions in those messages, but you may still receive communications necessary to process and service your order.
You are responsible for providing and maintaining a valid email address.
21. Privacy
Our collection, use, and disclosure of personal information are governed by our Privacy Policy.
By using our website, you acknowledge that online transmissions and data storage cannot be guaranteed to be completely secure.
You are responsible for protecting your account information, devices, passwords, and access credentials.
Notify us promptly if you believe your account or payment information has been used without authorization.
22. Third-Party Services and Links
Our website may use or link to third-party services such as Shopify, payment processors, shipping carriers, analytics providers, social-media platforms, and other websites.
We do not control third-party websites or services and are not responsible for their independent content, availability, security, policies, or practices.
Your use of third-party services may be governed by their own terms and privacy policies.
A link to a third party does not necessarily mean Bass Boots endorses or guarantees that third party.
23. Prohibited Uses
You may not use the website or services to violate any law, infringe intellectual-property or privacy rights, impersonate another person, submit false information, commit fraud, transmit malicious code, interfere with site security, scrape or harvest information without authorization, harass others, or disrupt the operation of the website.
You may not attempt to bypass purchase restrictions, security measures, checkout controls, or access limitations.
We may suspend or terminate access when we reasonably believe these Terms have been violated.
24. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided on an “as is” and “as available” basis.
We do not guarantee that the website will always be uninterrupted, secure, error-free, or free from harmful components.
Product warranties, if any, are limited to those expressly stated in writing by Bass Boots.
We do not disclaim warranties or consumer rights that cannot legally be excluded, including any applicable implied warranties that cannot be waived.
25. Limitation of Liability
To the fullest extent permitted by law, Bass Boots and its owners, officers, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from or connected with the website, products, services, or these Terms.
This may include lost profits, lost revenue, lost data, loss of opportunity, or similar losses, even if the possibility of such damages was known.
To the fullest extent permitted by law, our total liability arising from a particular order, product, or transaction will not exceed the amount you paid to Bass Boots for the product giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited or excluded. They also do not eliminate remedies available for valid product-liability, personal-injury, fraud, willful misconduct, gross-negligence, statutory, or consumer-protection claims where such limitations are prohibited.
26. Assumption of Ordinary Risks
Music festivals and outdoor events may involve crowds, uneven terrain, wet surfaces, mud, darkness, heat, weather exposure, extended standing, physical activity, and other risks beyond the control of Bass Boots.
Purchasing Bass Boots does not mean that Bass Boots assumes responsibility for event conditions, third-party conduct, venue safety, weather, or the customer’s decisions.
Customers remain responsible for exercising reasonable judgment, following venue rules, monitoring product condition, and choosing footwear appropriate for the activity and environment.
This section does not waive claims arising from a legally actionable defect in a Bass Boots product.
27. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold Bass Boots and its owners, officers, employees, contractors, agents, and affiliates harmless from third-party claims, liabilities, damages, judgments, and reasonable expenses arising from your unlawful use of the website, your material violation of these Terms, your infringement of another person’s rights, or content you submit.
This obligation does not require you to indemnify Bass Boots for Bass Boots’ own negligence, unlawful conduct, or obligations that cannot legally be shifted to you.
28. Events Beyond Our Reasonable Control
Bass Boots will not be responsible for a delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, transportation disruptions, port congestion, customs delays, government action, supplier interruption, manufacturing failure, utility outage, cyberattack, or carrier disruption.
This section does not eliminate any legally required notice, cancellation, refund, or other customer remedy.
29. Fraud and Policy Abuse
We may investigate and take reasonable action regarding suspected fraud, payment abuse, chargeback abuse, false claims, altered or substituted returns, unauthorized transactions, promotional misuse, or other deceptive conduct.
Reasonable action may include canceling an order, refusing a return, limiting future purchases, suspending access, preserving records, or cooperating with payment providers, carriers, insurers, or law enforcement.
Any action will be based on available evidence and will not restrict rights that cannot legally be waived.
30. Governing Law
These Terms and transactions with Bass Boots are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where federal law applies or where the laws of your state or country provide protections that cannot be waived.
31. Venue and Disputes
Before filing a formal legal claim, you agree to contact Bass Boots at support@bassboots.co and make a good-faith effort to resolve the dispute informally.
Bass Boots will also make a good-faith effort to resolve customer disputes before pursuing formal action.
Unless applicable law permits or requires another location, legal proceedings relating to these Terms or a Bass Boots transaction may be brought in a court with appropriate jurisdiction located in Ozaukee County, Wisconsin.
Nothing in this section prevents either party from bringing an eligible claim in small-claims court or exercising a right that cannot legally be restricted.
32. Severability
If any part of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent legally permitted or removed to the minimum extent necessary.
The remaining provisions will continue in effect.
33. No Waiver
Our failure to enforce any provision of these Terms does not waive our right to enforce it later.
A waiver is effective only if it is clearly made in writing by an authorized representative of Bass Boots.
34. Assignment
You may not transfer your rights or obligations under these Terms without our prior written consent.
We may transfer our rights and obligations as part of a merger, acquisition, sale of assets, reorganization, financing, or transfer of the Bass Boots business, subject to applicable law.
35. Entire Agreement
These Terms, together with the policies referenced in them and the information presented at checkout, form the entire agreement between you and Bass Boots concerning your use of the website and purchase of our products.
They replace prior discussions, statements, or agreements concerning the same subject, except for a separate written agreement signed by Bass Boots.
If information presented at checkout clearly provides more specific terms for a particular order, those specific terms will control for that order to the extent of any direct conflict.
36. Changes to These Terms
We may update these Terms periodically by posting a revised version on our website.
The Terms in effect when an order is placed will generally govern that transaction, except when a later change is required by law or is more favorable to the customer.
Changes governing general website use become effective when posted unless otherwise stated.
Continued use of the website after revised Terms take effect constitutes acceptance of the revised Terms for future use.
